Boise Brew Card Promotion
Purchase Terms and Conditions

Please carefully read the following agreement regarding purchase terms and conditions. which apply your order, purchase, and use of Boise Brew Cards, a product promoted and sold by Boise Smart Card LLC d/b/a Boise Brew Cards (hereafter “BSC,” “us,” or “we”) through the website www.boisebrewcard.com (hereafter the “Site”) or by any other means.  The following terms and conditions shall hereafter collectively be referred to as the “Brew Card Promotion” or “Promotion.”   

1. Terms of Promotion.
   1. The Brew Card Promotion incorporates herein the terms of all other BSC terms and conditions including, without limitation, BSC’s Privacy Policy and Terms of Use, which can be accessed on www.boisebrewcard.com and any additional deal-specific terms that may be advertised in connection with or on any products or services you purchase from BSC (known as the “fine print” regardless of how labeled). By ordering or purchasing a Boise Brew Card you agree to be bound by the terms of this Promotion and all terms and conditions incorporated herein by reference.
   2. To the extent that any inconsistencies exist between the terms of this Promotion and the terms incorporated herein by reference, the terms of this Promotion will prevail.
2. How to Participate in Promotion.
   1. Boise Brew Cards are discount cards through which merchants and/or vendors including, without limitation, various local brewers, specifically identified on the Boise Brew Card (hereafter collectively “Merchants”) offer their products for sale at a discount. By presenting the Brew Card to participating Merchants, Card Purchasers (hereafter “Purchasers” or “You”) may receive discounts on Merchant products which may include, without limitation, alcoholic beverages.
   2. You are prohibited from participating in this Promotion if you are under the age of 21 and legally permitted to consume alcohol in any jurisdiction in which you intend or attempt to participate in the Promotion.
   3. You must possess a valid Brew Card to participate in the Promotion.
   4. You must present your Brew Card to participating Merchants to receive applicable discounts.
   5. Your participation in the Promotion is subject to each Merchant’s discretion and the terms and conditions set forth herein.
3. Eligibility.
   1. Promotion is void where prohibited or restricted by law.
4. Miscellaneous.
   1. Product disclaimer:  BSC makes no express or implied warranties, representations, or endorsements whatsoever (including, without limitation: warranties of title, merchantability, or fitness for particular purpose) with respect to any products or services that may be referenced, described, or promoted via Brew Cards
   2. Liability limitation:  In no event shall BSC be liable to you or any third party for consequential, indirect, incidental, special, exemplary, punitive, or enhanced damages arising out of, or relating to, and/or in connection with your purchase or consumption of any Merchant products sold to you or any other party under the Promotion.
   3. Indemnity: You agree to defend, indemnify, and hold BSC, its directors, offices, employees, and agents harmless from and against any claims, lawsuits, penalties, damages, losses or expenses (including, without limitation, attorney fees and costs) arising out of or relating to (i) any breach or alleged breach of the terms of this Promotion by you; or (ii) any claim arising out of or relating to the products and services provided by Merchant to you, including, without limitation: claims for false advertising; personal injury; death; property damages; consumption by minors; and claims in any way relating to the sale or consumption of alcohol.
   4. Limits of use of logos on Brew Cards: You acknowledge and agree that the content of the Brew Card including without limitation, BSC or Brew Card logos, trademarks, services marks, works, graphics, or other materials, are protected by copyrights, trademarks, service marks, patents, or their property rights and laws and is the sole property of BSC and/or its affiliates or third-party licensors.  You may not reproduce, modify, distribute or transmit any portion of the Brew Card without BSC’s expressly written consent.  Any unauthorized use of the Brew Card’s protected content, as described herein, may subject you to civil or criminal penalties.
